These Terms of Service (“Terms”) govern your access to and use of CreateSocial (“the Service”, “we”, “us”, or “our”), operated by CreateSocial (“Company”), accessible at createsocial.ai. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Account Registration
To use CreateSocial, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account.
You agree to notify us immediately at hello@createsocial.ai if you suspect unauthorized access to your account.
2. Description of Service
CreateSocial is a content creation platform that provides tools for content idea generation, video recording with teleprompter, video editing, subtitle generation, content repurposing, and multi-platform scheduling. The Service uses artificial intelligence to assist with content creation. Features and functionality may change over time as we improve the platform.
3. Subscription and Billing
3.1 Plans and Pricing
CreateSocial offers paid subscription plans. Current pricing is available on our website. We reserve the right to change pricing with 30 days' written notice to active subscribers. Price changes will take effect at the start of your next billing cycle.
3.2 Free Trial
New accounts may be eligible for a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan and your payment method will be charged unless you cancel before the trial ends.
3.3 Billing
Subscriptions are billed in advance on a monthly or annual basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You are responsible for keeping your payment information current.
3.4 Credits
The Service uses a credit-based system for video processing. Credits are allocated monthly based on your subscription plan. Unused credits do not roll over to the next billing period. Credits are reserved when you push a recording to the library and are consumed upon successful processing. If processing fails, credits are automatically refunded to your account.
3.5 Refund Policy
All subscription payments are non-refundable. This includes monthly and annual subscription fees, and any fees for the current billing period after cancellation. We do not provide refunds or credits for partial months of service, unused credits, or downgraded accounts.
If you cancel your subscription, you will retain access to the Service until the end of your current billing period. No refund will be issued for the remaining time.
3.6 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at hello@createsocial.ai. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until that date.
4. Content Ownership
4.1 Your Content
You retain full ownership of all content you create using CreateSocial. This includes videos, recordings, scripts, ideas, captions, and any other materials you produce through the Service. We do not claim any ownership rights over your content.
4.2 License to Operate
By uploading or creating content on CreateSocial, you grant us a limited, non-exclusive, worldwide license to host, store, process, and transmit your content solely for the purpose of providing and improving the Service. This license exists only while your content is on our platform and terminates when you delete your content or close your account.
4.3 AI-Generated Content
Content ideas, captions, and other text generated by the Service's AI features are provided to you for your use. You own the output and may use it however you choose. We do not guarantee the accuracy, originality, or suitability of AI-generated content. You are responsible for reviewing and editing AI-generated content before publishing.
5. Acceptable Use
You agree not to use the Service to:
- Create, upload, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Violate any applicable law, regulation, or third-party rights (including intellectual property rights)
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any part of the Service or other users' accounts
- Use the Service to send spam, unsolicited messages, or bulk content
- Use automated scripts, bots, or other means to access the Service outside of normal use
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or redistribute access to the Service without our written consent
We reserve the right to suspend or terminate accounts that violate these terms at our sole discretion, with or without notice.
6. Third-Party Services
CreateSocial integrates with third-party platforms for publishing (including TikTok, Instagram, YouTube, LinkedIn, and X/Twitter) and uses third-party services for authentication, payment processing, AI processing, and video transcription. Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
When you connect your social media accounts to CreateSocial, you authorize us to publish content on your behalf to those platforms at your direction. You may disconnect your accounts at any time through your settings.
7. Intellectual Property
The Service, including its design, features, code, documentation, and branding, is owned by CreateSocial and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that AI-generated content will be accurate, original, or suitable for any particular purpose. We do not guarantee any specific results from using the Service, including follower growth, engagement, or revenue.
9. Limitation of Liability
To the maximum extent permitted by law, CreateSocial and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless CreateSocial and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any rights of a third party.
11. Account Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, or for any other reason at our sole discretion with reasonable notice. Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period following termination.
You may delete your account at any time by contacting us at hello@createsocial.ai. Account deletion is permanent and your content will be removed from our systems within 30 days.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you are located in a jurisdiction that grants you the right to bring claims in your local courts.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
